Remember District Attorney Alvin Bragg? He was the one who indicted former President Donald Trump for falsifying campaign records, resulting in his technical “arrest.”
Penny has been in the media as of late for putting an erratic man, Jordan Neely, in a chokehold and accidentally killing him. All this took place in the captive environment of a New York City subway car. Penny claims death was not his intention.
When news broke, the progressive left rushed to condemn Penny.
Check out this bit from leftist Sam Seder’s show on the whole thing. He actually appeared on the PBD podcast. On the show they said Neely was simply an innocent man asking for help:
But witnesses didn’t see it that way. A week later one witness publicly said, “The man got on the subway car and said an aggressive speech, he said he was hungry, thirsty, and said he didn’t care about going to jail, didn’t care if he got a life sentence.” The man said he feared that Neely could have been armed. Another one spoke anonymously to the NY Post saying, “I hope he has a great lawyer, and I’m praying for him. And I pray that he gets treated fairly, I really do. Because after all of this ensued, I went back and made sure that I said ‘Thank you’ to him.”
Should the guy be charged with anything at all? These statements indicate that Penny’s fellow straphangers felt their lives were in danger.
Now second degree means there was an unlawful killing without implied or express malice.
So essentially, the law says, a fatal accident occurred that could have been avoided. For example, if you lose control of your car and kill a bunch of pedestrians, that would not be second degree manslaughter. But if you were drinking and driving and killed someone, then you’d be charged with second degree manslaughter.
Penny will be looking at a maximum of 15 years in prison.
Bragg felt he could split the baby in this whole situation. Progressives were calling for a murder charge. Defenders of Penny were calling for a complete exoneration.
But Penny has more than enough to hire an ace legal team, perhaps making it likely he’ll get off. He’ll have 2 million bucks donated from concerned citizens across the country for his legal defense funds.
It’s surprising that Bragg isn’t backing down. Both the mayor New York City and the governor had a wait and see approach before casting judgment. If Bragg let Penny off, they probably wouldn’t push back. But clearly, the District Attorney answers only to the radicals.
