Maryland resident Tammy Nobles, whose daughter was allegedly raped and murdered by a teenage immigrant from El Salvador with ties to the MS-13 gang, has filed a $100 million lawsuit against the Biden administration for its failure to secure the southern border. Nobles, who also testified in the Republican-led impeachment inquiry against Department of Homeland Security (DHS) Secretary Alejandro Mayorkas, claims that DHS is “playing Russian roulette with our lives” and that the federal government should be held responsible for the ensuing tragedies.
In July 2022, Nobles’ autistic daughter Kayla Hamilton was raped and strangled to death with a phone cord just three days after her 20th birthday. The 17-year-old suspect, an undocumented El Salvadoran immigrant with known ties to the notorious MS-13 criminal organization, had been living with Hamilton in a trailer home that was sublet from another illegal immigrant. He was arrested in January 2023 when DNA evidence linked him to the scene, and he has been charged with murder and rape, as well as robbery for stealing $6 off Hamilton’s body.
The suspect (whose identity has not been released) will stand trial in June of this year.

According to Nobles, a simple background check at the border would have easily revealed her daughter’s killer’s criminal history. Instead, a series of security lapses allowed the suspect to flee from a holding facility in Texas and travel all the way to Maryland.
“He had a record, a criminal record in El Salvador in 2020. And he also had gang tattoos,” the grieving mother told Fox News on Thursday. “All they had to do was make one phone call to pull up his criminal record in El Salvador to find out… he was on the list for and listed as a known gang member of MS-13. Those two things should have kept him from entering the country.”
Shortly after making this statement, Nobles testified on Capitol Hill at an impeachment hearing for Department of Homeland Security Secretary Alejandro Mayorkas. Congressional Republicans have accused Mayorkas of “dereliction of duty” at the U.S.-Mexico border, leading to record rates of illegal immigration.
“For me, this not a political issue; this a safety issue for everyone living in the United States,” Nobles told the House Homeland Security Committee. “This could have been anyone’s daughter. I don’t want any other parent to live the nightmare that I am living. I am her voice now and I am going to fight with everything I have to get her story told and bring awareness of the issue at the border.”

Two days later, Nobles and attorney Brian Claypool announced a $100 million lawsuit against Mayorkas’ department, as well as the Department of Health and Human Services (HHS).
“We’re bringing this lawsuit because we’re tired of being held hostage in our own country. We’re tired of DHS playing Russian roulette with our lives [and] with Kayla’s life,” Claypool told News Nation, highlighting how the suspect’s visible gang tattoos should have disqualified him from entering the country in the first place.
According to the suit, DHS failed to prevent the suspect from entering the country, while HHS failed to confirm that he had a “verified sponsor” or known relative in the U.S.
“I want everyone to know what’s going on at the border,” Nobles said. “I had no clue what was going on before my daughter was brutally murdered and raped — but I do now.”
