New text messages are changing the conversation around the Cornell University case.

Jane Doe, a former Cornell student, alleges she was drugged and sexually assaulted by seven members of the Chi Phi fraternity in October 2024, and she has sued the university, the fraternity, and the men she accused. But texts from the Title IX investigation, reviewed by ABC News, show that days after that night, when one of the accused men apologized to her, she replied that none of the sexual stuff was illegal and that she really liked being with him.

About two weeks later, her messages to the same man changed: she wrote that 90% of what happened that night was not consensual. Days after that, she went to campus police.

Her attorney says she was in denial and traumatized in the days after the alleged assault, and notes that the man in those texts was expelled by Cornell. Now New York Attorney General Letitia James has been appointed special prosecutor after Governor Kathy Hochul said she’d lost faith in the local district attorney’s handling of the case.
