On Monday, the Georgia Court of Appeals unexpectedly canceled oral arguments scheduled for December 5 regarding the appeal by Donald Trump and co-defendants seeking to disqualify Fulton County District Attorney Fani Willis from prosecuting the 2020 election interference case. This decision follows allegations of a conflict of interest due to Willis’s past romantic relationship with former special prosecutor Nathan Wade, which Trump argues should lead to her removal.
In a one-line order, the court declared that the arguments were “hereby canceled until further order of this Court” and provided no further details.
In August 2023, a federal grand jury indicted Trump and 18 others on multiple RICO charges, accusing them of conspiring to illegally overturn the 2020 presidential election in Georgia. Four defendants pled guilty, but Trump and his remaining co-defendants maintained their innocence, using allegations about Willis’ relationship with Wade as the basis for an appeal.

Superior Court Judge Scott McAfee previously ruled there was no conflict warranting Willis’s disqualification, contingent on Wade’s resignation, which he submitted.
With Trump set to assume office in January, the future of this and other legal proceedings remains uncertain, especially as federal cases face delays.
The court’s brief order did not provide a reason for the cancellation, leaving the timeline for any further action unclear. Meanwhile, legal experts note that the Georgia state case against a sitting president could face constitutional and practical challenges.
