Disney has reversed its decision to seek arbitration in a wrongful death lawsuit filed by Jeffrey Piccolo, whose wife, Kanokporn Tangsuan, died from an allergic reaction at a Disney restaurant. The lawsuit, which Disney initially contested due to a subscriber agreement from Piccolo’s Disney+ subscription, will now be litigated in court.

As Valuetainment previously reported, Disney had argued that Piccolo’s subscription to Disney+ required disputes to be settled out of court, a position criticized by Piccolo’s legal team as “outrageously unreasonable.” However, following public backlash, Disney chairman Josh D’Amaro stated that the unique circumstances of the case warranted a sensitive approach, leading to the decision to waive arbitration.

Piccolo is seeking damages exceeding $50,000 under Florida’s Wrongful Death Act for emotional pain and loss of companionship, as well as to cover his wife’s funeral expenses. The case has sparked broader discussions about corporate responsibility and consumer safety in dining establishments.
