Just hours before Hunter Biden’s former business partner, Devon Archer, was scheduled to testify as to affairs within the Biden family, the Department of Justice (DOJ), requested his surrender to prison.

Over the weekend, five House Republicans called on lawmakers to return to Capitol Hill after the U.S. Attorney’s Office for the Southern District of New York received a request from the DOJ followed by a letter requesting Archer’s surrender. The request came in only hours before he was scheduled to testify on Hunter’s business dealings and the alleged role of his father, President Biden, in securing certain deals.

Surprisingly, the DOJ’s request for Archer’s surrender is completely unrelated to the Bidens and based on two felony convictions for Archer’s “role in a conspiracy to defraud a Native American tribe,” according to Politico. The 2022 sentence was repeatedly postponed due to a long-running set of appeals.

“In light of the foregoing, the Government respectfully requests that the defendant be ordered to surrender, at a date and time determined by the Court, to a facility designated by the Bureau of Prisons to commence his term of imprisonment,” it reads.

It is worth noting that Department of Justice never sends letters of request like this on a Saturday, according to House of Oversight Committee chairman James Comer.

“The DOJ is now actively committing the crime of obstructing a congressional investigation,” Republican Representative Matt Gaetz wrote. “If Devon Archer isn’t in the witness chair Monday, we better haul every SOB at the DOJ before Congress EVERY DAY to make them pay for this.”

Gaetz further mentioned that if Archer was not in the courthouse on Monday, Attorney General Merrick Garland would be called to testify.

Archer’s attorney Matthew Schwartz claimed that the request was in no way related to the upcoming closed-door interview, stating “We are aware of speculation that the Department of Justice’s weekend request to have Mr. Archer report to prison is an attempt by the Biden administration to intimidate him in advance of his meeting with the House Oversight Committee on Monday.”

Schwartz added, “To be clear, Mr. Archer does not agree with that speculation. In any case, Mr. Archer will do what he has planned to do all along, which is to show up on Monday and to honestly answer the questions that are put to him by the Congressional investigators.”

Archer’s testimony before the House Oversight Committee is expected to begin at 9 a.m. Monday, July 31.
