A federal appeals court announced the Biden administration violated the First Amendment by working with social media companies to remove falsely misleading COVID-19 content.
The White House, surgeon general, Centers for Disease Control and Prevention and the FBI “likely coerced or significantly encouraged social-media platforms to moderate content” and in doing so, “likely violated the First Amendment,” the New Orleans-based Fifth US Circuit Court of Appeals determined on Friday.

“There would be no way for a federal official to know exactly when his or her actions cross the line from permissibly communicating with a social-media company to impermissibly ‘urging, encouraging, pressuring, or inducing’ them ‘in any way,’” the judges wrote.
The three-judge panel weighed in on the preliminary injunction issued by U.S. District Judge Terry Doughty in July. The injunction directed specific Biden administration agencies and top officials to refrain from communicating with social media companies concerning certain content.

The panel’s verdict was criticized as being “both vague and broader than necessary to remedy the plaintiffs’ injuries, as shown at this preliminary juncture.”
The lawsuit in question had been initiated by Republican attorneys general, who argued that the Biden administration’s insistence on maintaining open channels with social media companies was essential. Their rationale was rooted in the need for the federal government to play a role in safeguarding the public against various threats, including those related to election security, COVID-19 misinformation and other potential dangers.
The fifth circuit left part of the injunction that barred certain Biden administration officials from “threatening, pressuring or coercing social-media companies in any manner to remove, delete, suppress, or reduce posted content of postings containing protected free speech.”
The appeals court added: “But those terms could also capture otherwise legal speech. So, the injunction’s language must be further tailored to exclusively target illegal conduct and provide the officials with additional guidance or instruction on what behavior is prohibited.”
Officials subject to the injunction include White House press secretary Karine Jean-Pierre, employees of the Justice Department and FBI, Health and Human Services Secretary Xavier Becerra, and Surgeon General Vivek Murthy.
The Biden administration has 10 days to seek a Supreme Court review of the ruling.
