The Georgia Court of Appeals ruled on Thursday to disqualify Fulton County District Attorney Fani Willis from prosecuting Donald Trump in the 2020 election interference case due to a perceived conflict of interest. While the court declined to throw out the case against Trump entirely, the justices also determined that Willis and her team have “no authority to proceed” given past accusations of impropriety by the DA.

“After carefully considering the trial court’s findings in its order, we conclude that it erred by failing to disqualify DA Willis and her office,” the court ruled. “The remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring.”

The appellate court ruled that an earlier decision allowing Willis to remain on the case was erroneous and failed to address the appearance of impropriety stemming from her previously undisclosed relationship with special prosecutor Nathan Wade.

Though the court acknowledged that “an appearance of impropriety generally is not enough to support disqualification, this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings.”

“Accordingly, we reverse the trial court’s denial of the appellants’ motion to disqualify DA Willis and her office,” the filing states. “As we conclude that the elected district attorney is wholly disqualified from this case, ‘the assistant district attorneys — whose only power to prosecute a case is derived from the constitutional authority of the district attorney who appointed them — have no authority to proceed.”

This decision marks a significant legal victory for Trump, who has consistently alleged misconduct against Willis.

“In granting President Trump an overwhelming mandate, the American People have demanded an immediate end to the political weaponization of our justice system and a swift dismissal of all the Witch Hunts against him,” Trump communication director Steve Cheung said after the ruling. “We look forward to uniting our country as President Trump Makes America Great Again.”

Although the indictment against Trump remains intact, the ruling raises questions about who will now handle the case moving forward.

Willis’s office has contended that her previous work demonstrates the case’s merits, irrespective of the recent ruling. The implications of this ruling could lead to delays in the trial process as the case transitions to new prosecutors.
