A New York judge has granted Donald Trump permission to seek the dismissal of his hush money criminal case, while also postponing his sentencing indefinitely. This decision, predicated on his impending second term as president, effectively ends attempts to prosecute him for 34 felony counts relating to payments made to adult film actress Stormy Daniels prior to the 2016 election.

Trump’s legal team must submit their dismissal arguments by December 2, with prosecutors required to respond by December 9. The defense argues that proceeding with the case during his presidency would create “unconstitutional impediments” to his governance.

The case, which involves a $130,000 payment to silence claims of an affair, marks the first time a former or sitting US president has faced a criminal conviction.
