New York Attorney General Letitia James confirmed on Tuesday that her office will not dismiss the $500 million civil fraud case against President-elect Donald Trump despite his request following his election victory. James argues that presidents are not immune from civil lawsuits regarding unofficial conduct and that such litigation does not impede a president’s official duties as outlined in the U.S. Constitution.
Trump’s legal team sought dismissal of the case, calling for national unity, but James’ office rejected this, stating the lawsuit is based on extensive investigations into Trump’s business practices, including inflated asset valuations.
“The ordinary burdens of civil litigation do not impede the President’s official duties in a way that violates the U.S. Constitution,” Deputy Solicitor General Judith Vale wrote in a letter to the Trump legal team.

A New York court has already ordered Trump to pay approximately $454 million in damages, a figure that has increased with interest.
Trump’s appeal of this ruling is currently pending, and the attorney general’s office maintains that the ongoing case “does not in any way affect Trump’s ability to serve as president.”
This stance is supported by Deputy Solicitor General Judith Vale, who emphasized that the civil nature of the case renders Trump’s other legal challenges irrelevant.
Since his election night victory, multiple other criminal cases against Trump have been thrown out or suspended indefinitely given state and federal policies preventing charging a sitting president.
