The US Department of Health and Human Services has rolled out a series of new guidelines in order to accommodate its transgender and nonbinary employees.
The Gender Identity Non-Discrimination and Inclusion policies, released just in time for “National Coming Out Day,” allow workers to wear clothing and use restrooms associated with their own self-identification … and it also requires coworkers to affirm them or else risk termination.
“When individuals bring their whole selves to work, all of us at HHS thrive,” says a departmental email made public by Heritage Foundation Vice President Roger Severino last month. “We want to ensure that HHS continues to be a welcoming, supportive environment where all employees feel safe and seen, including transgender and non-binary employees.”
The email continued by outlining its new Gender Identity Non-Discrimination and Inclusion Guidance, which includes a number of policies for “safeguarding … all employees’ gender expression.” These include programs to easily process name changes in department systems and a requirement that all employees “be addressed by the names and pronouns they use to describe themselves.”

Severino, who served as HHS Director of the Office of Civil Rights under Donald Trump, declared that the “Orwellian” mandate to use gender-affirming pronouns will force employees to “deny biological realities with their own words or face firing.”

“HHS and the federal government is requiring its employees to speak falsehoods,” the Heritage Foundation vice president told Fox News. “They are faced with a horrible dilemma. Do they hope that they can fly under the radar and try to avoid the issue and keep a low profile and perhaps hide their faith so they can keep their job, or do they stand up and say this policy is wrong and fight for their rights? And then see a gigantic target on their back after that.”

The push to penalize misgendering in government departments began with two executive orders from the White House in 2021 and 2022 that framed the issue as a way to combat “gender discrimination” in the workplace.
An unlisted YouTube video circulated within the Department of Health and Human Services further clarifies these guidelines and features a message from HHS Assistant Secretary Admiral Rachel Levine, a biological male who identifies as transgender. “Who you know yourself to be is valid,” he says.
The video also celebrates the fact that employees can dress as they please and use restrooms and locker rooms corresponding to their identity — potentially exposing female employees to the “quintessential hostile work environment” of a naked man at work.
“Governments cannot compel speech and certainly cannot compel false speech,” Severino argued. “We protect the right of political dissent and here it’s a pledge of allegiance to the Rainbow flag that’s been essentially required.”
